Aldon Smith facing three felony weapons charges image

San Francisco 49ers linebacker Aldon Smith is facing multiple felony weapons charges stemming from an incident at a house party.

According to the NBC Bay Area Investigative Unit, three felony charges of possession of an assault weapon have been filed by the District Attorney's office. The Santa Clara district attorney's office said that Smith is expected to surrended on his own later this month.

That is more bad news for Smith, who is on indefinite leave from the team after an arrest on DUI and marijuana possession charges. He is undergoing treatment for substance abuse at an in-patient facility.

"We've been aware of the incident, the serious nature of it," 49ers coach Jim Harbaugh said Wednesday. "We're all accountable for our actions, good and bad. There's a due process that will take place. I don't feel any need to comment further on it."

At the 2012 house party, Smith was stabbed and two others in attendance were shot. Two guests at the house party were shot.

There is no claim that Smith was the shooter, but the incident did occur at his home near San Jose. The civil lawsuit accuses Smith of shooting into the air and of owning illegal firearms. Smith and then-teammate Delanie Walker, now with the Titans, were both named in the suit filed by a man who said he was shot at the party. The players charged $10 admission and $5 per drink.

Smith set the 49ers' record last season with 19-1/2 sacks.

If convicted, Smith, who previously arrested on suspicion of DUI in January 2012 in Miami, could face up to four years and four months in jail, according to the district attorney's office.
