Prosecutors believe the six-time Paralympic gold medallist should have been convicted of murder and not culpable homicide after admitting killing girlfriend Reeva Steenkamp in February 2013.

And they will now argue their case in November to the Supreme Court of Appeal, which confirmed the date of the hearing on Tuesday.

Pistorius was convicted of culpable homicide and sentenced to five years in prison last September, with Judge Thokozile Masipa declaring that the state had not proved the athlete had intended to kill Ms Steenkamp.

The 28-year-old, who fired four shots into a locked toilet door in his Pretoria home, has always maintained that he mistook Ms Steenkamp for an intruder.

If convicted of murder, Pistorius would face a minimum of 15 years in prison.

Pistorius was expected to be released from prison last month to serve the remainder of his sentence under house arrest. 

However, a second hearing to decide whether he should be released has since been delayed.
