Peephole lawsuit: US sports journalist seeks $75 million in damages image

Erin Andrews is seeking $75 million in damages from Marriott International and other parties in connection with a 2008 incident in which she was videotaped through the peephole in a hotel room.

The Smoking Gun obtained documents filed this week in a Davidson County, Tenn., court, where the broadcaster's lawsuit is scheduled for trial in February. The filing came in response to a complaint by defense attorneys that Andrews' claims were "unreasonably vague and ambiguous."

The suit centers on Michael David Barrett, who in December 2009 pleaded guilty to stalking Andrews and was sentenced to 30 months in prison. According to the complaint, employees at the Nashville Marriott at Vanderbilt University not only told Barrett that Andrews was staying at the hotel in September 2008 but also put him in an adjacent room to hers. Barrett then modified the peephole in Andrews' room so he could see into it and used it to film her "changing and/or getting dressed." Barrett later uploaded the videos to a website.

Andrews didn't find out about the videos until July 2009; her complaint says their dissemination has caused her "great emotional distress and embarrassment." The complaint accuses the hotel of negligence and invasion of privacy in helping facilitate Barrett's actions and Barrett of intentional infliction of emotional distress.
